THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.6289 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of the Code of Criminal Procedure, 1973 by the petitioners/A-3 and A-4 seeking to quash the proceedings in Crime No.161 of 2013 on the file of Rajam Town Police Station, Srikakulam pending on the file of the Judicial First Class Magistrate, Rajam, Srikakulam District.

2. Heard and perused the material available on record.

3. The offences alleged against the petitioners are punishable under Sections 420 and 406 I.P.C.

4. The truth or otherwise of the said allegations can be ascertained by the Investigating Agency during the course of investigation. Therefore, this Court is not inclined to interfere with the proceedings against the petitioners in the above crime.

5. At this stage, learned counsel for the petitioners submitted that in view of the pendency of the above crime, the petitioners are apprehending arrest and also harassment in the hands of police.

6. The offences are not so serious in nature. It is evident that the case was registered in the year 2013. So far, the police concerned have not taken any steps to arrest the petitioners. It is informed by the petitioners that they are ready to cooperate with the investigation. Considering the said facts and circumstances of the case, the petitioners are directed to appear before the police concerned on or before 10.5.2016 and execute a bond for a sum of Rs.10,000/- (Rupees ten thousand only) each with one surety for the like sum each for their future appearance and shall also file affidavits informing the

police that they will cooperate with the investigation. On such execution of bonds and affidavits, the police concerned are directed to complete the investigation and file a final report, if any, without arresting the petitioners.

7. With the above directions, the Criminal Petition is disposed of. Miscellaneous petitions pending, if any, in this Criminal Petition shall stand closed.
