THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE M. SEETHARAMA MURTI FAMI LY COURT APPEAL No.136 of 2007 JUDGMENT: (Per Hon'ble Sri Justice Sanjay Kumar) This appeal was filed by the husband who approached the Family Court, Hyderabad, by way of F.C.O.P.No.746 of 2005 seeking dissolution of his marriage with the respondent/wife under Section 13(1)(ia) of the Hindu Marriage Act, 1955. The said O.P. was disposed of by the Family Court vide order dated 10.07.2007 granting the relief of judicial separation instead of a divorce decree.

While so, the matter was referred to the Mediation and Arbitration Centre, High Court of Judicature at Hyderabad for the State of Telangana and the State of Andhra Pradesh, and after completion of the mediation proceedings, the Deputy Director of the Mediation and Arbitration Centre submitted report dated 07.09.2016 stating to the effect that the mediation was successful. The settlement agreement signed by both parties in the presence of witnesses is placed before us indicating that the couple agreed to live together peacefully as their disputes now stand settled. In that view of the matter, this appeal does not survive for consideration on merits and is accordingly dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
