HON'BLE SRI JUSTICE P. KESHAVA RAO CRIMINAL REVISION CASE No.661 of 2018 ORDER:

Heard the learned counsel for the petitioner. The present revision case is filed questioning the orders, dated 16.02.2018 passed in Crl.M.P. No. 755 of 2011 on the file of the Court of the Additional Judicial Magistrate of First Class, Shadnagar, dismissing the petition filed under Section 311 Cr.P.C.

Learned counsel appearing for the respondents 2 and 3 raised a preliminary objection with regard to the maintainability of the revision on the ground that the order impugned is only an interlocutory order.

Learned counsel appearing for the petitioner after arguing for some time, seeks permission of this Court to withdraw the revision with liberty to file a petition under Section 482 Cr.P.C.

Acceding to the request of the learned counsel for the petitioner, the criminal revision case is dismissed as withdrawn giving liberty to file a petition under Section 482 Cr.P.C.

Miscellaneous petitions, if any, shall also stand dismissed.
