THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.1979 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C) by the petitioners/accused Nos.34, 40, 41 & 43 seeking to quash the Cr.No.24 of 2016 of Amberpet Police Station, Hyderabad, registered for the offence under Sections 406 and 420 I.P.C. and Section 7 of Essential Commodities Act.

Heard the learned counsel for the petitioners/accused and the learned Public Prosecutor and perused the material available on record.

The learned counsel for the petitioners submits that the petitioners/accused are apprehending arrest in view of the pendency of the above crime.

Having regard to the facts and circumstances of the case and in view of the nature of offence alleged against the petitioners and also in view of the order dated 12-02-2016 passed in Crl.P.No.1709 of 2016 by this Court, this Court is not inclined to interfere with the proceedings against the petitioners/accused.

However, the Respondent-Police are directed to investigate the matter and to file final report, if any, without arresting the petitioners.

The petitioners/accused are directed to appear before the Investigating Agency as and when their presence is required, and cooperate with the Investigating Agency.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending, shall stand closed.
