THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION No.1415 OF 2013 ORDER:

The relief sought for in this Writ Petition is to declare the action of the respondents in not including the petitioners names in the voters list, and to furnish a fresh voters list by revising the voters list dated 31.12.2012 to enable them to participate in the ensuing elections scheduled on 31.01.2013 and 04.02.2013 to the 5th respondent society, as arbitrary and illegal.

While the Writ Petition was admitted on 22.01.2013, no interim order was passed. As elections to the 5th respondent society must have been held on 31.01.2013 and 04.02.2013 in accordance with the earlier voters list, and as nearly four years has since elapsed, the cause in the Writ Petition does not survive necessitating any further adjudication by this Court. The Writ Petition has become infructuous and is, accordingly, dismissed. The miscellaneous petitions pending, if any, shall closed. No costs.
