THE HONOURABLE SRI JUSTICE T.AMARNATH GOUD W.P.No. 9052 of 2019 ORDER:

Heard both sides and perused the material available on record.

It is the case of the petitioner that originally his father was the absolute owner, possessor and pattadar of the lands in Survey Nos.152, 223 and 227 to an extent of Ac.7.26 gts, Ac.4.38 gts and Ac.0.31 gts with Khatha No.70, 270 situated at Maddukuru Revenue Village Chandrugonda Mandal, Bhadradri Kothagudem District in the year 1950 and they were assigned by the Government. The petitioner is one of the biological son along with others.

In view of the dispute amongst the siblings, the dispute has been preferred by way of O.S.No.160 of 2018 before the 2nd respondent. Since the 2nd respondent is not disposing of the said suit, the petitioner is before this Court. Without going into the merits of the case, it is just and proper to dispose of the writ petition.

Accordingly, the writ petition is disposed of directing the 2nd respondent to decide the suit as expeditiously as possible. No costs.

Miscellaneous petitions, if any, pending in this petition shall stand closed.
