CVNR,J & MSKJ,J WP.23055 of 2017 THE HON'BLE SRI JUSTI CE C.V.NAGARJUNA REDDY & THE HON'BLE SRI JUSTI CE M.S.K.JAI SWAL WRI T PETI TI ON No.23055 of 2017 ORDER: (per Hon'ble Sri Justice C.V.Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus, directing respondent No.4 to produce the husband of the petitioner, by name, Syed Rafiquddin (for short "the alleged detenu") before the Court and set him at liberty. In the counter affidavit, filed by the Inspector of Police, Special Operation Team, Malkajgiri, Rachakonda Commissionerate, Hyderabad, it was inter alia stated that the enquiries of the deponent revealed that the alleged detenu, who was Accused No.1 in Cr.No.
478 of 2017, registered for the offences under Sections 420, 406 IPC and under Section 24 of Immigration Act, of Kushaiguda Police Station, Rachakonda Commissionerate, was arrested on 11.07.2017 and produced before the XX Metropolitan Magistrate, Malkajgiri on 12.07.2017 and that the court has remanded him to judicial custody, in pursuance of which, the alleged detenu has been lodged in Central Prison, Cherlapally, Ranga Reddy District.
At the hearing, the learned counsel for the petitioner is not present.
