This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), seeking for grant of anticipatory bail to the petitioner-accused No. 1 in Crime No. 69 of 2018 of Satyanarayanapuram Police Station, Vijayawada City, registered for the offences punishable under Section 8 (c) read with Section 20 (b) of NDPS Act and Sections 3 and 4 of A.P. Gaming Act.

Heard learned counsel for the petitioner and learned Public Prosecutor (A.P.).

The case of the prosecution is that Ganja was provided by the petitioner to other accused.

Though the quantity of Ganja involved in this case is only 4.1 kilograms, considering the facts of the case, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the Court below having jurisdiction. The Court below shall dispose of the bail application, if any filed, on merits expeditiously, preferably on the same day, subject to pressure of other work.

Subject to the above, the criminal petition is dismissed. Pending miscellaneous petitions if any shall stand dismissed in consequence.
