Adi Usha Devi Yadav v. The State Of Telangana
THE HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO WRI T PETI TI ON NO.7551 OF 2018 ORDER:
The petitioner states that she is the owner and possessor of house property bearing Municipal No.10-1-214/1 situated in a land admeasuring 150 Sq.yards in Survey No.8 at Old Marredpally, Secunderabad. She purchased the said land under a registered sale deed dated 26.10.1978 and has been in possession of the same since the date of purchase. She further states that when some persons approached her on 14.11.2017 asking to vacate the said house for the alleged purpose of construction of Telangana double bed room scheme, she filed Writ Petition No.38756 of 2017 and obtained an interim order not to interfere with her possession of the said property. She further states that as a retaliation, the 4th respondent issued a notice Under Section-7 of the Andhra Pradesh Land Encroachment Act by proceedings dated 2.1.2018. She submitted a detailed explanation along with the documents on 6.1.2018 and in spite of the same, she filed the present Writ Petition challenging the said notice dated 2.1.2018. 2.
Since the notice was issued and enquiry is yet to be completed, this Court is not inclined to interfere with the same
at this stage, more so, when the petitioner submitted her detailed explanation on 6.1.2018.

In view of the same, the 4th respondent is directed to consider the explanation submitted by the petitioner in accordance with law and pass appropriate orders. Till final orders are passed, the 4th respondent is restrained from interfering with the property of the petitioner. 4.
The Writ Petitioner is disposed of.
Pending miscellaneous petitions, if any, shall stand closed. No order as to costs.
