Dr. Rtn. Palagiri Sudheekar, v. The State Of Andhra Pradesh Rep. By Its Principal Secretary
THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 11040 of 2015 Date of Judgment: 22.6.2015 Between:
Dr. Rtn. Palagiri Sudheekar
...Petitioner
And The State of Andhra Pradesh and others ..Respondents THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR W.P. NO. 11040 of 2015 ORDER:
Heard learned counsel for the parties.
The petitioner is aggrieved by the inaction of the respondents in completing the survey, though surveyor had given notice for conducting survey as early as on 11.8.2014.
Learned Government Pleader for Revenue, on instructions, submits that Sy.No. 384 to an extent of Ac.845 cents is not sub-divided. He further says that under BSO 34 and Section 11 of the A.P. Survey and Boundaries Act, 1923 the petitioner can approach the
competent authority for sub-division and survey of the land in question.
Hence the petitioner is permitted to approach the competent authority for the purpose of sub-division as well as survey afresh and submit the documents of title on which he makes his claim. If such an application is filed, the competent authority shall look into the matter and take appropriate further steps in the matter expeditiously. The writ petition is accordingly disposed of. Miscellaneous applications, if any, shall stand closed. No order as to costs.
