HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7509 of 2018 ORDER:

In this writ petition, petitioners challenge the notification dated 08.08.2017 issued under Section 19(1) of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (Act 30 of 2013).

Though various grounds have been raised in the writ petition, learned counsel for the petitioners restricts his argument to the extent that the land Acquisition Officer neither had given opportunity while considering the objections filed by the petitioner on 15.05.2017 nor had passed any orders thereon. He would submit that, in similar circumstances, this Court, in W.P.No.7016 of 2017 and batch dated 30.08.2017, granted liberty to the petitioners therein to file comprehensive written objections either individually or for the entire village in accordance with Section 15(2) of Act 30 of 2013, and the present writ petition may be disposed of in terms thereof.

Learned Government Pleader for Land Acquisition made available a copy of the instructions dated 08.03.2018 from the Land Acquisition Officer, wherein it is stated that the objections were heard on 31.05.2017; orders were passed by the appropriate Government and became final as per Section 15(3) of Act 30 of 2013; award enquiry was conducted on 26.09.2017; and the case is at award stage.

Notwithstanding the said written instructions, learned Government Pleader for Land Acquisition agrees with the submission of the learned counsel for petitioners that the writ petition may be disposed of in terms of the order in W.P.No.7016 of 2017 and batch dated 30.08.2017. In the circumstances, the Writ Petition is allowed in terms of the order in W.P.No.7016 of 2017 and batch dated 30.08.2017.

Miscellaneous petitions pending, if any, shall stand dismissed. No order as to costs.
