THE HON'BLE SRI JUSTICE S.V.BHATT W.P.No.12305 of 2007 ORDER:

Petitioner prays for the following relief :- " .... to issue writ, order or direction, more particularly one in the nature of writ of mandamus declaring the action of the respondents in issuing Notification ROC No.SW/ 249/ 2007/ G4 dt.02-05-2007 to acquire the lands in an extent of Ac .1.02 cts in R.S.No.374/ 2 of the petitioner of Kaldhari Village, Undrajavaram Mandal, West Godavari District, as illegal, arbitrary and contrary to the provisions of the Land Ac quisition Act and also A.P.Agricultural Land Conversion for Non-agricultural Purpose Act and set aside the same consequently directing the respondents to stop further proceedings including dispossession of the petitioner from the said lands...."

4th respondent has filed counter affidavit and paragraph '3' thereof reads as under :- " It is respectfully submitted that the above proposal was dropped and alternative land was acquired as some of the farmers of the same village came forward to give their lands for acquisition for provision of house sites to the weaker section people and alternative land in R.S.No.290, 296 etc . measuring Ac.6.92 cts was proposed for acquisition and draft notification was published vide Roc.G4/ 249/ 2008 (SW) dated 11.10.2007 of the Collector, West Godavari District and consent award in 26/ 2008 (SWLA) was also passed and house site pattas have been distributed to the beneficiaries. In view of the above, the

writ petition is liable to be dismissed as the land of the petitioners was not at all acquired by the Government." Counsel for petitioner requests the Court to place the stand of respondents on record and close the writ petition. By placing the above statement on record, the writ petition is closed accordingly. No order as to costs.
