THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER Criminal Revision Case No.665 of 2018 ORDER:

This Criminal Revision Case, under Sections 397 & 401 of the Code of Criminal Procedure, 1973, is filed by the petitioners/ A.2 to A.4, A.6 & A.7, aggrieved by the docket order, dated 06.02.2018, passed in S.C.No.573 of 2014 by the V Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar.

Heard the learned counsel for the petitioners/ A.2 to A.4, A.6 & A.7, learned Assistant Public Prosecutor representing the 1st respondent-State and perused the record.

The learned counsel for the petitioners/ A.2 to A.4, A.6 & A.7 would submit that the learned Sessions Judge passed the impugned docket order without assigning any reasons and ultimately prayed to allow the Revision.

The impugned docket order, dated 06.02.2018, passed in S.C.No.573 of 2014 by the V Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar, reads as follows:- " A3, A6 & A7 called absent and their absence is condoned on petition. Other accused called present. Crl.Mp.No.404/2017 is dismissed. Witnesses not produced on the condition of ordering next step. Call on 16-02-2018."

The impugned order passed by the learned Sessions Judge is bereft of reasons. It goes to show the non application of judicial mind. The circumstances do require reasoned order. Under these circumstances, the impugned docket order is liable to be set aside.

Accordingly, this Criminal Revision Case is allowed and the impugned docket order, dated 06.02.2018, passed in S.C.No.573 of 2014 by the V Additional District & Sessions Judge, Ranga Reddy District at L.B.Nagar, is set aside. Consequently, Crl.M.P.No.404 of 2017 is restored to file with a direction to the learned Sessions Judge to pass orders in the said M.P. afresh, in accordance with law. Miscellaneous Petitions, if any, pending in this Criminal Revision Case, shall stand closed.
