HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35687 of 2016 ORDER:

This writ petition is filed seeking to declare the action of the 3rd respondent in registering the Crime No.84 of 2016, on the file of Sydapuram Police Station, SPSR Nellore District, as illegal and arbitrary.

Heard and perused the material available on record. The main grievance of the petitioners is that there are some civil disputes between the petitioner and the 4th respondent in the year 2012 and the registration of Crime No.84 of 2016 clearly discloses that some civil disputes are pending between the petitioner and the 4th respondent, who signed as a witness in execution of Sale Deed in favour of the petitioners in the year 1997 vide Doc.No.32 of 2000, dated 17.02.2000.

Considering the grievance of the petitioners, the 3rd respondent is directed to complete the investigation in Crime No.84 of 2016, as expeditiously as possible and file a final report, if any, either way in accordance with law, within a period of six (6) months from today without arresting the petitioners. The petitioners are directed to appear before the 3rd respondent as and when required for the purpose of investigation. Accordingly, the writ petition is disposed of. No costs.
