P. Sambaiah, v. The State Of Telangana (Formerly
THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN And THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTH WRIT PETITION No.4117 of 2015 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) This writ petition is preferred against the order of the Andhra Pradesh Administrative Tribunal in C.A.No.814 of 2012 in O.A.No.6764 of 1999 dated 20.12.2012. C.A.No.814 of 2012 is an application filed under Section 17 of the Administrative Tribunals Act requesting the Tribunal to punish the respondents for violating the order of the Tribunal in O.A.No.6764 of 1999 dated 17.11.1999. The Tribunal took note of the submission of the learned Government Pleader that, pursuant to the directions given by the Tribunal earlier, proceedings dated 30.01.2001 were issued by the Government. The Contempt Application was closed granting liberty to the petitioner to adjudicate, if he was so aggrieved.
An application to punish the respondents for contempt is merely in the nature of information, brought to the notice of the Tribunal, that its order has been violated. Whether action should, or should not, be taken for contempt thereafter is a matter exclusively in the jurisdiction of the Tribunal. The petitioners cannot be said to be aggrieved by an order of the Tribunal closing the contempt application.
The present writ petition, questioning the order of the Tribunal closing the contempt case, is wholly misconceived and is, accordingly, dismissed.
Miscellaneous petitions pending, if any, shall also stand dismissed. There shall be no order as to costs.
