THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35501 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed by the petitioners seeking to quash FIR No.179 of 2016 on the file of Tadipatri Town Police Station, Anantapur District, registered against the petitioners for the offences under Sections 420, 406 and 506 IPC. Heard and perused the material available on record. The 3rd respondent lodged a complaint against the petitioners stating that the petitioners approached him for leasing out his vehicles to them on monthly rent of Rs.1,45,000/ - and took the vehicles by paying advance rent of Rs.1,00,000/ - and thereafter, evaded payment and when the 3rd respondent asked for the rent, they abused and threatened him with dire consequences.

Learned counsel for the petitioners submitted that the petitioners are innocent of the offences alleged against them, and there is no record to show that the 3rd respondent leased out his vehicles to them and they were falsely implicated in this case. Considering the circumstances of the case and also the submissions of the learned counsel for the petitioner, without expressing any opinion on merits, the 2nd respondent is directed to complete the investigation in Crime No.179 of 2016 of Tadipatri Town Police Station, Anantapur District, and file a final report in accordance with law in either way, without arresting the petitioners. The petitioners are also directed to appear before the investigating officer as and when required and cooperate with the investigation.

With the above directions, the Writ Petition is disposed of. No costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
