THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.25808 of 2017 ORDER:

This writ petition is filed for the following relief: "to issue an appropriate Writ, Order or Direction more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not releasing the cash of Rs.1,95,290/- belongs to the 1st petitioner and 70 bags of Jaggery (each bag contain 30 Kgs.) and 30 bags of Aalam (each bag contains 30 Kgs.) belongs to the 2nd petitioner which was seized in Cr.No.19/2017 on the file of the P.S. Mahadevpur, Jayashanker Bhupalpally (Karimnagar) District in spite of the readiness to furnish the third party surety, as being illegal, arbitrary and unjust and consequently direct the 2nd respondent to release the above cash of Rs.1,95,290/- and 70 bags of Jaggery (each bag (each bag contain 30 Kgs.) and 30 bags of Aalam (each bag contains 30 Kgs.) to the petitioners respectively"

Heard learned counsel for the petitioners and learned Government Pleader for Home (Telangana) for respondent Nos.1 and 2 and learned Government Pleader for Prohibition and Excise (Telangana) for respondent No.3.

When the matter is taken up, the learned Government Pleader for Home, on the basis of written instructions received from respondent No.2, has submitted that the Police, Mahadevpur sent the seized cash and the goods to the Court of Additional Judicial Magistrate of First Class, Manthani.

In view of the same, no relief can be granted in the present writ petition and, hence, it is dismissed, with liberty to the petitioner to approach the Court of Additional Judicial Magistrate of First Class, Manthani for necessary orders.
