These two writ petitions are being disposed of by this common order, as they arise out of identical circumstances. 2.

The petitioners state that they are in possession of different plots of land and have been paying taxes to the first respondent. They were granted 'B' Form Pattas in the year 1994 taking into consideration the long standing possession by them. However, when a notice was issued by the first respondent asking them to vacate the land at the instance of the third respondent, the present writ petitions were filed.

A reading of the impugned notices issued in August, 2012, shows that there was an allegation of unauthorised occupation of the municipal land by the petitioners on the road margin. 4.

Since the issue involves verification of facts on the basis of the documents, this Court is not inclined to entertain these writ petitions, but gives liberty to the petitioners to submit their explanation to the impugned notice duly enclosing the documents, if any, within a period of thirty (30) days from the date of receipt of a copy of this order and the first respondent shall consider the same and pass appropriate orders there on after hearing the petitioners, within a period of three (03) months thereafter. Till such time, no action shall be taken by the first respondent for dispossessing the petitioners.

Both these writ petitions are disposed of accordingly. There shall be no order as to costs. As a sequel, miscellaneous petitions, if any, pending in these writ petitions shall stand closed. _____________________________ A. RAMALINGESWARA RAO, J 01st November, 2016 Bvv
