HONOURABLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.21272 of 2014 ORDER:

Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for respondent Nos.1 to 3.

The prayer sought in the writ petition is as under: "... to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus to declare the action of the respondent No.2 and 3 herein in not taking any action on the complaint dated 16.07.2014 in spite of the repeated visits made by the petitioner, as being illegal, arbitrary, unjust and consequently direct the respondent No.3 herein to take action against the respondent Nos.4 and 5 pursuant to the complaint dated 16.07.2014 in accordance with law."

Learned Government Pleader placed on record written instructions dated 16.12.2019 issued by the Sub-Inspector of Police, Nawabpet Police Station, Vikarabad District. From a perusal of the said written instructions, it is revealed that the petitioner sent a petition to the Superintendent of Police, Vikarabad, through registered post stating that her husband is the owner of land admeasuring Ac.6.00 guntas in Sy.Nos.383/P and 383/77 of Banswada Village, Nizambad District and he is missing since 2006 and his whereabouts are not known. Therefore, she requested to take necessary action. The said petition was forwarded to the 3rd respondent for enquiry. The 3rd respondent caused an enquiry and submitted report to the Superintendent of Police, Vikarabad on 13.10.2014 stating that the complainant

Chandramma was not present in the village since few days and she is residing at Hyderabad and is not cooperating with the Station House Officer regarding the complaint given by her, as such, the petition was closed.

In view of the above said statements, this Court is of the opinion that no further cause would survive in the writ petition and the same is liable to be closed. Accordingly, the writ petition is closed. However, liberty is given to the petitioner to lodge a fresh complaint and cooperate with the 3rd respondent, who, in turn, is directed to conduct investigation as per law. The presence of the 3rd respondent is dispensed with. No order as to costs. Miscellaneous petitions, if any, shall also stand closed. _____________________ P. KESHAVA RAO, J Date: 16.12.2019.
