THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.9187 OF 2019 ORDER:
Heard both sides.
The petitioner is aggrieved by granting of building permission in favour of respondent No.3, vide building permit dated 07.03.2019.
The petitioner asserts that she also has claim over the subject property. On earlier occasion when the petitioner applied for building permission, such permission was rejected pointing out certain defects. Thereafter, the petitioner has fulfilled the short falls and resubmitted for grant of building permission. In the meanwhile, the petitioner came to know that respondent No.3 was granted building permission on 07.03.2019. Raising objections with regard to granting of such permission to respondent No.3, letter dated 09.04.2019, was made and the same is not being considered by the respondents - authorities.
Learned Standing Counsel would submit that the objection raised by the petitioner would be considered in due course of time.
There being no dispute that the petitioner has submitted objections on 19.04.2019, with regard to building permission, granted in favour of respondent No.4, the Writ Petition is disposed of with a direction to the respondents - authorities to consider the objections of the petitioner dated 19.04.2019,
after issuance of notice to respondent No.3, initially by examining tenability of the claim of the petitioner and thereafter take necessary action, if necessary, by issuing notice to respondent No.3 and consider the same, in accordance with law, within a period of eight weeks from the date of receipt of a copy of the order. There shall be no order as to costs.
Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.
