This petition is filed, under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'Cr.P.C.'), seeking for grant of anticipatory bail to the petitioner-accused No. 2 in Crime No. 53 of 2018 of Reddigudem Police Station, Krishna District, registered for the offence punishable under Section 307 read with Section 34 IPC.

Heard learned counsel for the petitioner and learned Public Prosecutor (A.P.).

The case of the prosecution is that when the de facto complainant and others went to see the damaged UT Canal, the petitioner and others pushed the de facto complainant into the canal. The statements of the witnesses would testify about the said fact. Medical certificate is also filed, which shows that the de facto complainant sustained injuries.

Hence, considering the above, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner can file a petition seeking for regular bail by surrendering himself before the Court below having jurisdiction. The Court below shall dispose of the bail application, if any filed, on merits expeditiously, preferably on the same day, subject to pressure of other work.

Subject to the above, the criminal petition is dismissed. Pending miscellaneous petitions if any shall stand dismissed in consequence.
