HON'BLE SRI JUSTICE A.RAJASHEKER REDDY CIVIL REVISION PETITION Nos.826 & 827 OF 2020 COMMON ORDER:
The only grievance of the petitioners in these two civil revision petitions is that though they have filed two cheque petitions in suit OS No.9 of 2008 on 28-05-2020 'online' after serving notice on the other side, the Court below has not processed and numbered the cheque petitions to enable the petitioners to withdraw the amounts as directed by the Division Bench of this Court in AS No.386 of 2016 and AS No.247 of 2017 and modified by the Hon'ble Supreme Court in SLP No.15832 of 2018 by orders dated 13-07-2018 to the extent to furnish surety to the amount to be withdrawn.

Learned counsel for the petitioners submitted that in compliance of the directions of the Division Bench of this Court and also the Supreme Court, the petitioners have filed cheque petitions but the same are not being taken up due to COVID-19 pandemic, the petitioners are suffering with aliments, they require the amounts in question.

In the circumstances, the civil revision petitions are disposed of directing the Court below to process and number the cheque petitions and on such numbering, decide them on merits and pass appropriate orders thereon, as early as possible keeping in view the urgency pleaded in the matter. Miscellaneous petitions, if any, pending in these revision petitions shall stand closed. There shall be no order as to costs.
