HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No. 5502 OF 2012 ORDER:

Petitioner prays for the following relief:

"... Writ of mandamus declaring the action of the official respondents in threatening petitioner saying that payment receipt received from 7th respondent board to petitioner will be credited to loan account No.866577200031045 as illegal, arbitrary, unconstitutional and against the principles of natural justice and consequently direct respondents 3 and 4 not to credit the payment received from Tobacco Board to respondent No.5's loan i.e., 866577200031045."

Smt. T. Vidya Rani appearing for respondent Nos.3 and 4 submits that the writ prayer is unavailable as on date for the same is based on apprehension and anticipation of some step being taken by the Bank. As and when the Bank proposes to recover the subject loan, it is stated that the same will be in accordance with law and if the petitioner at that point of time is aggrieved, can certainly work out the remedies. Writ petition is closed, as no further order is necessary. There shall be no order as to costs.
