HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.7826 of 2015 ORDER:

This writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of respondent Nos.1 to 3 in not conducting verification process to determine the majority union and to accord recognition in respondent No.4 Corporation to the Union, which emerged as Majority Union, despite representations dated 12.09.2014, 20.10.2014 and 09.02.2015 as arbitrary and illegal and for a consequential direction to respondent Nos.1 to 3 to conduct verification process to decide the majority union.

The grievance of the petitioner is that the term of majority union was expired on 14.09.2014 and fresh verification has to be conducted for the purpose of recognition of majority union, but the same is not being conducted. In spite of representations dated 12.09.2014, 20.10.2014 and 09.02.2015 submitted by the petitioner, no action is being taken. Therefore, the present writ petition is filed. Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Labour.

Accordingly, the writ petition is disposed of directing the respondent Nos.1 to 3 to consider and dispose of the representations dated 12.09.2014, 20.10.2014 and 09.02.2015 submitted by the petitioner and take appropriate action in accordance with law within a period of six weeks from the date of receipt of copy of this order. There shall be no order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
