THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.1303 of 2009 ORDER:

The petitioners challenge award dated 31-01-2008 in I.D. No.85 of 2005. Through the award impugned in the writ petition, the Labour Court directed to employ the 1st respondent as and when petitioners make regular appointments in their organization by relaxing age and academic qualifications etc. The writ petition is dismissed for default against 1st respondent for non-compliance of conditional order dated 11-12-2012.

After lapse of three and half years, it appears that no steps are taken to rectify the defect. Since the writ petition is dismissed against the contesting respondent, the prayer cannot be considered.

Accordingly, the writ petition is dismissed. It is open to the petitioners, if so advised, to file appropriate petitions for restoration as well as setting aside the default order against 1st respondent. No order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
