This Civil Revision Petition, under Article 227 of the Constitution of India, is filed aggrieved by the order, dated 31.12.2018, in I.A.No.871 of 2017 in O.S.No.900 of 2001 passed by the I Additional Senior Civil Judge, Ranga Reddy District at L.B.Nagar.

Heard the learned counsel for the petitioner, and the learned counsel for the respondents. Perused the record. 3.

The petitioner herein filed the aforesaid Interlocutory Application under Order 1 Rule 10 read with Section 151 of the Code of Civil Procedure, 1908, to implead him as party defendant to the subject suit. The Court below, after hearing both sides, dismissed the said application.

Learned counsel for the petitioner would submit that the petitioner has purchased a piece of land in the suit schedule property, therefore, he has substantial interest over the same; that to show that the petitioner has right and title over the same, he also filed documents before the Court below, but without considering the same, erroneously the Court below dismissed the application and hence, he prays to set aside the impugned order. 5.

The petitioner filed certain documents to show that he has right and title over the subject property. Therefore, the petitioner

is proper and necessary party to the proceedings. Hence, the impugned order is liable to be dismissed.

Accordingly, the Civil Revision Petition is allowed.

Consequently I.A.No.871 of 2017 in O.S.No.900 of 2001 on the file of I Additional Senior Civil Judge, Ranga Reddy District at L.B.Nagar, filed by the petitioner is allowed as prayed for.
