SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2795 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioner, who is A6, in Crime No.177 of 2017 on the file of Tuni Rural Police Station, East Godavari District. The offences alleged are under Section 8(c) r/w 20(b)(ii)(c) of NDPS Act. 2.

Heard the counsel for the petitioner and the Public Prosecutor appearing for the respondent.

The case of the petitioner is that this petitioner is the owner of the vehicle and that knowing that Ganja was being transported in his vehicle, he permitted the driver to go ahead with the transportation. The confession of the driver shows that, when he received the offer of transporting Ganja in his vehicle, for a consideration of Rs.30,000/-, he informed the same to this petitioner and he agreed for the same.

Hence, in the light of the above allegations, this Court opines that it is not a fit case to grant anticipatory bail. 5.

Accordingly, the Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
