Learned counsel for the petitioner is present. Learned Additional Public Prosecutor for the State of Andhra Pradesh would represent that the Investigating Officer has filed a report before the Chief Judicial Magistrate -cum - Principal Senior Civil Judge, Visakhapatnam, seeking to close the crime on the ground "referred as false", and, therefore, the present petition has become infructuous.

In view of the aforesaid submission of the learned Additional Public Prosecutor, the criminal petition is dismissed as infructuous. Miscellaneous Petitions, if any, pending in this petition, shall stand closed.
