THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.4949 OF 2016 ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
"to call for the records from the Respondents and issue an appropriate Writ, Order or Direction, particularly one in the nature of Writ of Mandamus, declaring that the action of respondents in not considering the cases of petitioners for appointment for the post of RTC Constable and rejecting solely on the ground of over-age is illegal, unjust, contrary to law, arbitrary, discriminatory, irrational and violative of Articles 14, 16 and 21 of the Constitution of India; and grant all consequential benefits."
2. Heard Sri A.K.Jayaprakash Rao, learned counsel, appearing for the petitioner and Sri A.Rama Rao, learned counsel, appearing for the respondents.
3. During the course of hearing, it is submitted by the learned counsel for the petitioners herein that the petitioners herein submitted representations to the respondents herein requesting for appointment on compassionate ground. The same have not been considered so far against any suitable posts. It is further submitted by the learned counsel for the petitioners herein that the petitioners herein will submit representations to the respondents once again for their consideration for appointment on Compassionate grounds and the same may be directed to be disposed of, in accordance with law, by fixing some timeframe. The said request is not opposed by the other side.
4. For the aforesaid reasons, Writ Petition is disposed of, permitting the petitioners herein to submit representations with a request to consider the cases of the petitioners for appointment on compassionate ground, within a period of one month from the date of
receipt of a copy of this order, and if such applications are submitted within the time stipulated, the same be considered and appropriate orders be passed, in accordance with law, within a period of two months thereafter.
5. Miscellaneous petitions pending consideration, if any, in the Writ Petition shall stand closed in consequence. No order as to costs. __________________ A.V.SESHA SAI, J 21.03.2016 SS
