This Criminal Petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of pre-arrest bail to the petitioner, who is arrayed as accused in Crime No.27 of 2026 on the file of Nizamabad VI Town Police Station, Nizamabad District, registered for the offence punishable under Section 69 of the BNS.

Heard Sri N.Hari Prasad, learned counsel for the petitioner and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State. 3.

The case of the prosecution is that the de facto complainant lodged a report before police on 24.01.2026 alleging that 5 years ago, she came into contact with the petitioner and in

- 2 - due course of time, it was converted into love and the petitioner promised to marry her and thereby developed physical relationship with her in the year 2024, she became pregnant and on coming to know of the same to her parents driven her out of the house and the petitioner took her and kept her in a rented house and on 15.01.2025 she underwent surgery and gave birth to a male child but within two days the child died and still she continued to stay with the petitioner. It is stated that she asked the petitioner to marry her, but he dodged the matter on one pretext or other and went and she came to know that the petitioner got another marriage. Hence, she lodged a complaint.

Learned counsel for the petitioner-accused would submit that whatever the relationship between the petitioner and complainant is a consensus, there is deceitful words by the petitioner; that it is a prolonged relationship between the petitioner and the complainant; that the complainant gave birth to a child in the year 2024 and there is no any complaint by that time; that the petitioner is ready to cooperate with the investigation and hence he prays to grant bail to the petitioner.

On the other hand, learned Additional Public Prosecutor opposed the same and submits that the offence alleged against the petitioner is serious in nature and that the petitioner induced the complainant and thereby she became pregnant, as

- 3 - such at this stage, the petitioner is not entitled for grant of bail and hence, he prays to dismiss the petition.

Considering the submissions made by learned counsel for both parties and perusal of the material on record, it appears that the petitioner and the complainant stayed together for a period of five years and thereafter he denied to marry the complainant. Considering the prolonged relationship between the parties, this Court is inclined to grant bail to the petitioner subject to the following conditions:

(i) The petitioner-accused shall surrender before the Station House Officer, Nizamabad IV Town Police Station, Nizamabad District, within two (2) weeks from today, and on such surrender, the petitioner shall be released on bail on executing a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for a like sum each.

(ii) On such release, the petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier, and thereafter, as and when required.

(iii) The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
