THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM COMPANY PETITION No. 104 OF 2016 O R D E R:

This Company Petition is filed seeking winding up of the respondent Company on the ground that it failed and neglected to pay a sum of Rs.19,38,229/- to the petitioner Company. In its counter-affidavit, the respondent submits that though the petitioner supplied goods to it, the same were not as per the specifications.

In normal circumstances, this Court would have proceeded with the matter, however, particularly, in view of the fact that one of the operational creditors approached the National Company Law Tribunal, Hyderabad Bench, seeking winding up of the respondent, and petitioner had also filed its claim before the Interim Resolution Professional, the Company Petition is closed leaving it open to the petitioner to pursue the proceedings before the National Company Law Tribunal, Hyderabad Bench. Consequently, miscellaneous applications, if any pending shall stand closed.
