In this writ petition, the petitioner questions the action of the respondents in seizing 104.16 quintals of rice from his premises bearing D.No.6/194-2, Mydukuru Town, Badvel Road, YSR Kadapa District, under Panchanama, dated 31.08.2017, and consequently, prays for a direction to the respondents to release the seized stock. Heard learned counsel for the petitioner and learned Government Pleader for Civil Supplies appearing for the respondents.

A perusal of the Panchanama, dated 31.08.2017, discloses that the authorities have seized 161 FCI gunny bags of PDS rice; that the rice was transferred from FCI gunny bags to private bags and that there are 89 empty FCI gunny bags. This, prima facie, proves that the petitioner is involved in the clandestine business of PDS rice.

Hence, the writ petition is disposed of with the direction to the respondents to release the seized stock, subject to the petitioner furnishing bank guarantee equivalent to the value thereof, as determined by them, pending disposal of the proceedings initiated against him.
