THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.6976, 7003, 7117, 7184, 7186, 7235, 7271, 7278, 7279, 7282, 7307, 7371, 7700 AND 9431 OF 2017 COMMON ORDER:

These writ petitions are being disposed of by this common order, as they challenge the final order passed by the third respondent ordering the petitioners to vacate the land occupied by them. Earlier, a show cause notice was issued in the month of June, 2016 asking the petitioners to submit reply and attend for personal hearing. The petitioners did not submit any reply but submitted copies of the documents. They have not attended the personal enquiry also. When the petitioners approached this Court challenging the order of the third respondent, this Court passed an order on 06.03.2017, in view of the disputes raised with regard to the survey conducted earlier, giving liberty to the respondents to conduct survey in the presence of the petitioners.

Today a survey report is filed before this Court and the said survey report is being disputed by the petitioners on the ground that the survey was not properly conducted by taking proper boundaries. This involves verification and since there is a provision for appeal, liberty is given to the petitioners to file an Appeal to the competent authority within a period of thirty (30) days from today and the respondents shall not take any steps for eviction of the petitioners for a period of forty five (45) days from today. It is needless to observe that if no appeal is filed within the period specified, it is open to the respondents to take appropriate action in accordance with law.

The writ petitions are accordingly disposed of. Miscellaneous petitions, if any, pending in these writ petitions shall stand closed. __________________________ A.RAMALINGESWARA RAO, J 19.04.2017 Note: Issue order copy by 21.04.2017.
