SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2804 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A1 to A6, in Crime No.78 of 2016 on the file of Gollapally Police Station, Jagtial District. The offences alleged are under Sections 498A IPC and Section 4 of Dowry Prohibition Act.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The case of the prosecution is that the first petitioner and the defacto complainant lived together for two months and thereafter, he left for Dubai and later, she started living with her mother-in-law and then, the mother-in-law and petitioners 2 to 6, started harassing her on demand of additional dowry. The public prosecutor submits that Section 41A Cr.P.C. notice was issued to A2, A5 and A6 and that NBWs are pending against A1, A3 and A4.

Hence, considering the facts of the case and considering the above submissions made by the public prosecutor, this Court is inclined to recall the NBWs issued against A1, A3 and A4 and the police are directed to issue 41A Cr.P.C. notice to all the accused before arrest.

Accordingly and with the above direction, this criminal petition is disposed of. As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed. _____________ T.RAJANI, J 15.03.2018 SS
