HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.3573 of 2015 ORDER:

Heard the learned counsel for the petitioner and learned G.P.for Home.

Petitioner complaints about the illegal interference by the police, i.e., the second respondent relating to civil dispute pending between him and the third respondent. It is alleged that the third respondent borrowed an amount of Rs.1,70,000/- from the petitioner and inspite of repeated demands, he is not making the payment.

However, the third respondent appears to have influenced the second respondent, based on that, the second respondent is allegedly threatening the petitioner and on those allegations, this writ petition is filed.

Learned Government Pleader was required to get instructions. It is stated in the instructions that the mother of third respondent approached the second respondent by making a complaint that the petitioner herein is threatening her to repay the amount which her son borrowed from him and taken her house documents. But, on enquiry it was found that she was not aware of borrowing of money by her son, in that regard, the petitioner was called to know the factual aspects. It is stated that the dispute between the petitioner and the third respondent is purely civil in nature, hence both of them are advised to approach the competent civil Court and settle the dispute. It is stated that the third respondent is threatening the petitioner etc., is denied and on the contrary, it is stated that in fact the second respondent suggested both the parties to approach the competent civil Court

or settle the dispute properly by taking appropriate steps and declined to interfere with the civil dispute pending between the third respondent and the petitioner.

In view of the fact that as the second respondent is not interfering with the dispute, the same is recorded and the writ petition is disposed of by recording the same. No costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed.
