THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.21571 OF 2016 ORDER:

Heard the learned counsel appearing for both sides. With consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2. The present Writ Petition is filed with the following prayer: "to issue a writ or order/s more particularly one in the nature of Writ of Mandamus declaring the action of the 2nd respondent in not passing orders in stay petition filed by the petitioner on 26.06.2015 in Appeal No.G1/544/2015, by disobeying the order dated 09.11.2015 in W.P.No.23716 of 2015 passed by this Hon'ble Court, as being arbitrary, illegal and unconstitutional, and consequently suspend the operation of notice dated 29.05.2015 bearing No.G1/147/1166/2015 issued by the third respondent."

3. At the time when the matter is taken up for hearing, learned Standing Counsel for respondents 2 and 3 placed on record the notice dated 28.01.2016 issued by the Commissioner, Tandur Municipality, Ranga Reddy District, to show that the appeal preferred by the petitioner was rejected. In view of the above, he submits that nothing survives for adjudication in the writ petition.

4. Learned counsel for the petitioner submits that till date the order of rejection dated 28.01.2016 is not communicated to the petitioner.

5. Having regard to the above, the Writ Petition is dismissed as infructuous, directing the respondent authorities to

communicate the order dated 28.01.2016 within a period of one week from the date of receipt of a copy of this order enabling the petitioner to avail the remedy available under law. Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
