HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.7521 OF 2018 O R D E R :

The case of the petitioner is that he was appointed as Driver in the respondent Corporation in the year 1995, and his services were regularized in the year 1996. Subsequently, as the petitioner found unfit for the post of driver due to paralysis, an order dated 06.04.2017 was passed declaring the petitioner as unfit for the post of driver. Basing on the said order, the 3rd respondent retired the petitioner from service w.e.f.27.06.2017 on medical grounds and promised to settle his retirement benefits within one month. Even after lapse of one month period, the respondent authorities have not settled petitioner's retirement benefits. Petitioner also made a written representation on 07.08.2017 before the 3rd respondent requesting to settle his retirement benefits. As no action has been taken, present writ petition is filed. Heard learned counsel for the petitioner.

Sri A.Ravi Babu, learned Standing Counsel for respondent Corporation submits that except gratuity other retirement benefits have been released.

But, the same is disputed by the learned counsel for the petitioner.

In view of the aforesaid facts and circumstances, the 3rd respondent is directed to consider the representation of the petitioner dated 7.08.2017 for release of retirement benefits, if not already released, within a period of three weeks from the date of receipt of a copy of this order.

Accordingly, the writ petition is disposed of. No order as to costs.
