Crl.Petition No.2601 of 2022 HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO. 2601 OF 2022 O R D E R:

This Criminal Petition is filed under Sections 437 and 439 of the Code of Criminal Procedure, 1973 (for short "Cr.P.C.") seeking to enlarge the petitioner/Accused No.8 on bail in connection with Crime No.220 of 2021 on the file of Kattangur Police Station, Nalgonda District registered for the offence punishable under Section 20(b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'the NDPS Act').

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor for the respondent-State and perused the record. 3.

Briefly the case of the prosecution is that, police Kattangur arrested Accused Nos.1 to 5 on 05.10.2021 and seized ganja from them.

The present petitioner/accused No.8 was in jail in Crime No.260 of 2021 of Nalgonda Rural Police Station since 06.10.2021. During the course of investigation, on the basis of confession, the present petitioner was arrested and arrayed as Accused No.8 in the present crime, thereafter, he was produced before the court on

Crl.Petition No.2601 of 2022 execution of PT warrant. Admittedly, the basis for implicating the present petitioner/Accused No.8 is the confession of Accused Nos.1 to 5 and no seizures are effected.

In the said circumstances, the petitioner/Accused No.8 can be granted bail subject to the following conditions: i) The petitioner/Accused No.8 is directed to be released on bail on his executing personal bond for Rs.50,000/- (Rupees Fifty Thousand only) with two sureties for likesum each to the satisfaction of learned Judicial First Class Magistrate at Nakerekal. ii) The petitioner shall appear before the Station House Officer, Kattangur Police Station for a period of three (03) months, on every Wednesday and Sunday between 10.00 AM to 12.00 Noon. 6.

Accordingly, the Criminal Petition is allowed. 7.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
