THE HON'BLE SRI JUSTICE V. RAMASUBRAMANIAN AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA APPEAL SUIT No. 1325 of 2004 JUDGMENT: (Per VRS,J) This is a regular appeal filed by the Land Acquisition Officer under Section 54 of the Land Acquisition Act 1894, questioning the enhancement of compensation granted by the reference Court.
2. Mr. A.V. Sivaiah, learned Government Pleader, today brought to our notice a Government Order in G.O.Rt.No.101, dated 20.02.2006, as per which the Government decided not to press appeals arising out of the awards of the reference Court, by which enhancement of compensation was granted only to the extent of about 80%. The case on hand is covered by the said Government Order.
3. Following the aforesaid Government Order, several appeals have been dismissed by this Court. This fact was also recorded in an order passed on 25.11.2015 by a Bench of this Court in A.S.Nos.2693, 2826 and 3135 of 2003. Therefore, following the same, this Appeal Suit is
also dismissed.
Consequently, miscellaneous petitions if any pending in the appeal suit shall stand dismissed. There shall be no order as to costs.
