HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No. 9133 of 2019 ORDER:
1) The present Writ Petition came to be filed seeking issuance of Writ of Mandamus, to declare the respondent Nos.2 and 3 in disconnecting the Electricity Connection to the petitioner's house ie. Plot No.97 (H.No.16-70/ 63), Santosh Nagar Colony, Balaji Nagar, Jawhar Nagar, Medchal, Malkajgiri District, vide Service Connection (SC) No.2314 19119 without issuing any notice, without assigning any reasons and without giving an opportunity of being heard, as arbitrary, illegal and violation of principles of natural justice.
2) Heard learned counsel for the petitioner and Sri R.Vinod Reddy, learned counsel for respondents 1 to 3.
3) Learned counsel for the petitioner submits that without issuing any notice the respondents have disconnected the power supply to the petitioner's house. The same is not disputed by the learned counsel for the respondents.
4) Without going into the merits of the case and since the disconnection of the power supply is being made without issuing notice, this Writ Petition is disposed of directing the respondents to restore the power supply to the petitioner's house ie. Plot No.97 (H.No.16-70/ 63), Santosh Nagar Colony, Balaji Nagar, Jawhar Nagar, Medchal, Malkajgiri District, vide Service Connection (SC)
No.2314 19119, provided there are no dues. However, if for any other reason, the respondents are intending to disconnect the power supply, the same shall be informed to the petitioner by way of a notice and thereafter appropriate action can be initiated as per law.
