THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.2326 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1 to 5, 8, 9, 11 to 14, 16 to 19 and 22 in connection with Crime No.104 of 2021 on the file of Station House Officer, Ichoda Police Station, Adilabad, wherein the petitioners/Accused are alleged to have committed the offences punishable under Sections 147, 148, 307, 324, 120-B, 448, 427 read with 149 of Indian Penal Code (IPC).

Heard the learned counsel for the petitioners/Accused and the learned Assistant Public Prosecutor for the respondent-State. Perused the record.

The petitioners are also Accused in three crimes i.e. Crime Nos.102 of 2021, 103 of 2021 and 104 of 2021. In all the said three cases charge sheets have been filed and charges are also framed pursuant to the direction of this court on 06.04.2022. 4.

Learned Assistant Public Prosecutor submits that the bail granted to Petitioner/Accused No.1 (namely Abdul Rasheed) was

cancelled by this court in Crime No.102 of 2021 and when the matter was taken to the Hon'ble Supreme Court the same was declined.

Learned counsel for the petitioners submits that, the petitioners/Accused undertake to file an affidavit that they would not cause any hindrance to the trial and also to the effect that they will remain present on all dates of trial and for any reason they are absent on a given day of the trial is scheduled they would not dispute their identity.

In the said circumstances, this court is inclined to grant bail to the petitioners/Accused.

Accordingly, the Criminal Petition is allowed in part granting bail to the petitioners/Accused Nos.2 to 5, 8, 9, 11 to 14, 16 to 19 and 22 subject to the following conditions:

i) The petitioners/Accused Nos.2 to 5, 8, 9, 11 to 14, 16 to 19 and 22 shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties for a like sum each to the satisfaction of the Judicial First Class Magistrate at Boath.

ii) The petitioners/Accused Nos.2 to 5, 8, 9, 11 to 14, 16 to 19 and 22 shall file an affidavit as stated above and shall not indulge in threatening the witnesses or indulge in any quarrel. iii) In the event of petitioners/Accused Nos.2 to 5, 8, 9, 11 to 14, 16 to 19 and 22 violating any of the conditions, the bail is liable to be cancelled on an application made by the prosecution. iv) Earlier it was ordered by this court in Criminal Petition Nos.3468 of 2022 and 3472 of 2022 that the Accused stay outside the limits of Ichoda Police Station for a period of three months and the said condition was extended for another six months. v) The petitioners/Accused Nos.2 to 5, 8, 9, 11 to 14, 16 to 19 and 22 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C.

The Criminal Petition in respect of petitioner/Accused No.1 is dismissed.
