THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11737 of 2015 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents in not releasing Tractor (Swaraj) bearing No.735 FE, in spite of making application on 15.04.2015 for release of the vehicle is illegal and arbitrary, and consequently declare that the petitioner is entitle for release of the said vehicle.

Heard and perused the records.

Learned counsel for the petitioner submits that the vehicle stands in the name of the petitioner and that the petitioner is not involved in any criminal case and no case is registered against the petitioner, and as such, prays this Court to direct the third respondent to forthwith release the vehicle to the petitioner. In view of the above submission, the writ petition is disposed of with a direction to the third respondent to dispose of the application, dated 15.04.2015, of the petitioner requesting to release the vehicle, i.e., Tractor "Swaraj", bearing No.735 FE, to the petitioner, within a period of fifteen (15) days from the date of receipt of copy of this order. The writ petition is accordingly disposed of. There shall be no order as to costs. Consequently, miscellaneous petitions, if any shall also stand disposed of.
