THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45713 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking to declare the Look Out Circular in C.No.03/ CI.CCRB/ WGL/ 2016, dated 29.07.2016, issued by the 2nd respondent as infructuous in view of the final report filed by the 3rd respondent in Crime No.81 of 2016. Heard and perused the material available on record. The son-in-law of the petitioner lodged a private complaint against the petitioner and others, which was registered as Crime N.81 of 2016 for the offences under Sections 448, 427, 290 and 506 IPC. During penency of the case, the 2nd respondent addressed the impugned letter to the 5th respondent to issue LOC against the petitioner, and consequently, the authorities concerned issued LOC against him.

After completing the investigation, the police filed final report stating that the case is 'false', in the above crime. The grievance of the petitioner is that though the case was closed as 'false', the authorities concerned are not recalling the LOC issued against him, and hence, requested this Court to set aside the LOC pending against him. Considering the circumstances of the case and also the grievance of the petitioner, the Writ Petition is disposed of setting aside the Look Out Circular issued against the petitioner in connection with Crime No.81 of 2016 on the file of Madikonda Police Station, Warangal District. No order as to costs. Pending Miscellaneous Petitions, if any, shall stand closed.
