THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.9251 OF 2019 ORDER:

This Writ Petition is filed for the following relief: "To issue writ, order or direction more particularly one in the nature of writ of mandamus by declaring the action of the respondents in not disposing the petitioner's application as per the rules in force for building permission application No.3/C1/05416/2019, dated 18.03.2019, for Plot No.502 of Bhavana Nagar, as illegal, arbitrary and violative of principles of natural justice and consequently direct the respondents to grant building permission without referring to the shortfall letter dated 26.03.2019".

At the time of hearing, it is submitted by both the learned counsel that the subject matter is covered by the order passed in W.P.No.37810 of 2015, dated 19.04.2016 and, therefore, similar order may be passed in this Writ Petition as well.

This Court disposed of W.P.No.37810 of 2015 on 19.04.2016, with the following direction:

"The Writ Petition is accordingly allowed setting aside the impugned proceedings dated 13.03.2014. The Greater Hyderabad Municipal Corporation shall reconsider the building permission application of the petitioner on its own merits and in accordance with the Greater Hyderabad Municipal Corporation Act, 1955, and the rules and regulations framed thereunder."

In terms of the order dated 19.04.2016, passed in W.P.No.37810 of 2015 and for the reasons alike, this Writ Petition also stands allowed. There shall be no order as to costs.

Miscellaneous petitions pending in the Writ Petition, if any, shall stand closed.
