Heard, Sri Ravi Chimalapati, learned counsel appearing for the 4th respondent.

Aggrieved by the notice dated 30.03.2016 issued by the 4th respondent alleging that the petitioner had encroached certain land belonging to the village particularly the cremation ground.

Though it treats as notice, as a matter of fact, the 4th respondent had already come to the conclusion and there is no enquiry conducted before coming to the conclusion.

Learned standing counsel submits that as a matter of fact, what the Panchayat Secretary had made that it is only show cause notice, which is clear from the usage of word 'notice' on the top of the proceeding. However, he further submits that the petitioner may treat this as notice issued by the 4th respondent and he may submit his explanation, which shall be considered in accordance with law. In the light of the respective submissions, the writ petition is disposed of giving liberty to the petitioner to submit explanation within two weeks from today. As and when such explanation is submitted by the petitioner, the 4threspondent shall consider the same and pass appropriate orders. Till such time no coercive steps shall be taken by the respondents. There shall be no order as to costs. Miscellaneous petitions, if any pending in this writ petition shall stand closed. ______________________________ CHALLA KODANDA RAM, J.
