THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.30881 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The grievance of the petitioner is that respondents 2 to 4 are not amending the revenue records relating to R.S.No.173 wherein the petitioner claims to be the owner of Ac.5.57 cents of land as against Ac.4.87 cents recorded in Gaddamanugu Village, G. Konduru Mandal, Krishna District.

Learned counsel for the petitioner states that after repeated representations, the petitioner was forced to file the present Writ Petition.

Today when the matter has come up, learned Government Pleader for Revenue has placed the instructions received from the Tahsildar, G. Konduru Mandal, Krishna District, the 4th respondent, which sets out the details of all the extents taken over under the Urban Land (Ceiling and Regulation) Act, 1976 and the acquisition proceedings. It is also stated that as per the said record, the petitioner appears to have got Ac.4.36 cents of land on ground position. However, the documentary evidence in support of the petitioner's claim for Ac.5.57 cents of land is not produced. It is also stated that sub-division record prepared by the Mandal Surveyor is submitted to the Sub-Collector, Vijayawada, for scrutiny and necessary changes would be carried out in the revenue records. It is evident from the above that the process of verification and correction of revenue record is already initiated and is awaiting

approval of the sub-division record prepared by the Mandal Surveyor and placed before the Sub-Collector, Vijayawada. The instructions, however, show that the petitioner is entitled to only Ac.4.36 cents of land and if she claims Ac.5.57 cents of land, it is for her to produce the necessary document before the 4th respondent.

In these circumstances, the Writ Petition is disposed of directing the respondents to take all necessary steps and finalise the entries in the revenue records, expeditiously. It is also open for the petitioner to approach the 4th respondent and submit the documents in support of her claim for Ac.5.57 cents of land and if such documents are submitted, the same shall also be taken into consideration by the 4th respondent while finalising the entries in the revenue records. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
