This criminal petition is filed praying this Court to enlarge the petitioner on bail who is arrayed as accused No.1 in Crime No.1130 of 2025 before the Jagadgirigutta Police Station, registered for the offence punishable under Sections 103(1) r/w. 3(5) of BNS.

Brief facts of the case are that on 06.11.2025 at about 16:00 hours near Jagadgirigutta Bus Stop, Jagadgirigutta, the complainant Maturi Manohar lodged a report stating that while
- 2 - he and his friend Roshan Singh were alighting from a passenger auto, accused Bala Sow Reddy, Adhil, and Mahamood attacked Roshan Singh. It is alleged that Mahamood held Roshan's pant and instigated Bala Sow Reddy to stab him, whereupon Bala Sow Reddy repeatedly stabbed Roshan Singh with a knife, causing severe bleeding injuries on his stomach, chest, and back. Despite cries from the complainant and others, the accused continued the assault, and thereafter fled the scene on a bullet motorcycle. Roshan Singh was shifted to Meditech Hospital and later to Gandhi Hospital, where he succumbed to injuries.

Heard Sri Godugu Mallesham, learned counsel appearing for the petitioner and Sri Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondentState. 4.
Learned counsel for the petitioner submitted that the petitioner is innocent, falsely implicated, and has no connection with the alleged offence. He contended that most of the investigation is completed, statements of witnesses recorded, and charge sheet filed. The petitioner was remanded on 06.11.2025, police custody was granted, and investigation concluded. He further submitted that no prima facie case is
- 3 - made out, that the complaint is mala fide, and that the petitioner hails from a respectable family, owns properties, and is ready to cooperate with the investigation. Hence, prayed this Court to grant bail to the petitioner.

Learned Additional Public Prosecutor opposed the submissions stating that the complaint and investigation clearly reveal his active role in the offence, and that he, along with other accused, attacked and killed Roshan Singh with premeditated intention. He contended that the raid and subsequent investigation resulted in recovery of incriminating material, and that granting bail at this stage would hamper the prosecution case. As such, petitioner is not entitled for bail and prayed to dismiss this petition.

Having regard to rival submissions, and on perusing the material on record, it is noted that custodial interrogation of the petitioner is no longer required as investigation is completed and charge sheet filed. However, considering the gravity of allegations and the nature of offence, this Court is of the view that the petitioner is entitled to bail, subject to compliance with the following conditions:

The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only, with two sureties for a like sum each to the satisfaction of the XIV Additional Metropolitan Magistrate, at Kukatpally.
ii.
The petitioner shall co‐operate with the trial and shall further remain present before the trial Court on each and every date of hearing.
iii.
The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
