THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.907 OF 2017 ORDER:
This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking to quash the proceedings against them in C.C.No.366 of 2014 on the file of the XIII Additional Chief Metropolitan Magistrate, Nampally, Hyderabad.
Heard and perused the material available on record. The petitioners are alleged to have committed the offences punishable under Sections 498-A and 406 IPC and Sections 3 and 4 of the Dowry Prohibition Act. Considering the circumstances of the case, this Court is not inclined to interfere with the proceedings in the above C.C. However, the petitioners are at liberty to move an application before the trial Court under Section 205 Cr.P.C. On such application being filed, the trial Court is directed to dispose of the same, in accordance with law.
With the above directions, the Writ Petition is disposed of. There shall be no order as to costs. Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
