HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.7544 of 2018 ORDER:

Heard Mr.T.P.Acharya for petitioners and the learned Assistant Government Pleader (Home) for respondents 1 to 6. The petitioners pray for Mandamus declaring issuance of Red Corner Notice/ Look Out Circular in Cr.No.189 of 2017 dated 22.03.2017 on the file of 6th respondent as illegal, arbitrary and unconstitutional.

The Assistant Government Pleader places on record the instructions, dated 07.03.2018. The operative portion of the instructions reads as follows :- " No proposals whatsoever have been submitted to the authorities for opening of LOC/ Red Corner Notices against the petitioners herein who are residing in USA. This respondent police are trying to serve the summons on the accused A1 to A5 including the petitioners herein.

As a precautionary measure without any cause of action to prevent the police from issuance of any Red Corner Notice/ LOC against them, the petitioners filed the present writ petition.

It is pertinent to submit that the petitioners/ accused have to appear before the trial court as and when it is summoned by it till the disposal of the above Calendar Case. No red corner notice/ LOC was issued against the petitioners herein till date"
