HON'BLE SRI JUSTICE T. VINOD KUMAR WRIT PETITION NO.10099 OF 2020 ORDER:

The present writ petition is filed under Article 226 of the Constitution of India for issue of a writ of mandamus directing the respondent Nos.2 to 3 to provide protection to the petitioner to take clothes, important articles from the house bearing Municipal No.3-1-781/1 Thaggi Jail Masjid, Nimboliadda, Kachiguda, Hyderabad.

The present writ petition is taken up for hearing today, i.e. 05.08.2020, through Video Conferencing.

Heard learned counsel for the petitioner and learned Assistant Government Pleader for Home.

When the matter is taken up for hearing today, learned Counsel for the petitioner submitted that the petitioner has now approached the office of 3rd respondent authority on 01.08.2020 and submitted a letter dated 23.07.2020, detailing the items, which the petitioner intends to take out from the house bearing No.3-1-781/1 situated at Nimboliadda, Kachiguda, Hyderabad. Learned Counsel for the petitioner would further submit that the said letter was filed with one Mr. Subrahmanyam, working in the office of the 3rd respondent authority. Learned Counsel for the petitioner further submits that a copy of the same would also be sent to the Assistant Government Pleader for Home, to enable him to forward the same to the 3rd respondent authority.

Having regard to the submissions made and considering the fact that the petitioner has now made an application to the 3rd respondent authority, vide her letter dated 23.07.2020, submitted on 01.08.2020 indicating therein as to the items which the petitioner intends to take out from the subject house, this Court is of the view that the 3rd respondent authority can be directed to look into the same to issue necessary instructions to the concerned authority to extend protection to enable the petitioner to take out the personal belongings from the subject house on a prefixed day by communicating the same to the petitioner with atleast two days advance notice.
